Foulmouth Lekompo musician and content creator Nkgodisheng Paul Madubanya, popularly known as Tsaka RSA, will spend Christmas behind bars after the Polokwane Magistrate’s Court dismissed his bail application on Friday.
The 29-year-old has been in custody since his arrest on 9 October 2026. He faces charges of unlawful possession of a firearm and ammunition, failure to store a firearm in a prescribed safe, and statutory rape.
The State did not oppose his release on bail. However, after considering the circumstances placed before it, the court found that it would not be in the interests of justice to release the accused on bail.
It is alleged that on 9 October 2026, members of the South African Police Service, acting on information that Madubanya had an unlicensed firearm, proceeded to his residence in Rethabile Gardens.
An unlicensed firearm and ammunition were allegedly found at the residence, leading to his arrest.
Mashudu Malabi, the regional spokesperson for the NPA said the statutory rape charge relates to allegations that Madubanya had sexual intercourse with a 15-year-old minor. “Further details are being withheld to protect the identity and privacy of the minor.
The matter has been postponed to 17 January 2027 for further investigation. Madubanya remains in custody.
He recently appeared briefly in the Pretoria Magistrates’ Court, facing a charge of assault with intent to cause grievous bodily harm.
NPA spokesperson Lumka Mahanjana said the incident occurred in the early hours of August 2, when Madubanya was performing at Propaganda Night Club in Pretoria Central.
The controversial artist allegedly assaulted a male complainant by hitting him several times with an empty bottle crate.
The prosecuting body further said the alleged assault was initially stopped by bouncers at the establishment, who escorted both parties outside.
However, Madubanya allegedly continued assaulting the complainant outside the nightclub until the complainant’s friends intervened.
Mahanjana said the complainant subsequently reported the incident at the Pretoria Central Police Station, where a criminal case was opened. Following police investigations, Madubanya was arrested.
While he is still fighting for his freedom, he will spend Reconciliation Day, Christmas and New Year day behind bars.
